Cost to Register A Trade Mark

The cost to register a trade mark is dependent on the number of classes you require in your trade mark application. Following is a guide to costs to register your Australian trade mark through our office.

Unexpected costs are never welcome.  That’s why we charge our trade mark services on a flat fee basis where possible.

We promise there won’t be any nasty surprises or hidden costs.  What you see is what you get.

The schedule below provides full details about the cost of each of our services.  Note that our fees include all government charges, professional fees and GST for each of the stages shown. In the event of any additional services being required or further fees applicable, we will always get your approval prior to completion.

The cost to register a trade mark is dependent on the number of classes you require in your trade mark application. A class is basically a category of product or service, with 45 to select from. Fees are charged per class. Following is a guide to costs to register your Australian trade mark through our office.

Trade mark Searches (optional)

Prior to filing you may wish to consider having a trade mark search conducted. A search is a great way to determine whether your proposed trade mark will likely succeed in registration. We offer several search options, to suit different budgets:

Filing the Trade Mark Application

There are several filing options available that dictate the cost of filing a trade mark application.

Standard Application

The first option is filing a ‘standard’ application, using a picklist of goods and services provided by the trade marks office. Examination of a standard application fluctuates but may be several months before a result is known. This option incurs the following fees:

First Class on Application $895.00
Each additional class on application $610.00

Headstart Application

The second option (and, often recommended) is filing a ‘Headstart’ application, which provides an early assessment as to whether your trade mark will likely be accepted. This returns a report within around 5 business days as to whether the trade mark will be accepted, and, if the result is not positive, provides an opportunity to swap to a different trade mark. This option incurs the following fees (the difference between these fees and those above are simply differences in the official government fees payable).

First Class on Application $975.00
Each additional class on application $690.00
Amending to new trade mark if required $150 government fee per class

It is also possible to file a standard application without using the picklist of goods and services provided by the trade marks office. Typically this is not necessary, and, incurs higher fees again. Quotes available on request or as required.

Registration

Once your application is filed, the government department will examine it (in around 4 months) – and will accept it for registration if there are no problems. If no oppositions are filed, your trade mark will automatically register after the opposition period expires, approximately 7-8 months after filing.

Renewal of a Trade Mark – First Class (if renewed on time) $650.00

Filing a request to remove somebody’s trade mark for non-use $600.00

For example, if you use MMW Trademark Services to prepare and file a single trade mark application in a class that features on the Government’s published list, the flat fee is $895.00   Further fees apply if you prefer to describe your goods/services in your own words.

If you wish to file a trade mark application in multiple classes, the cost to register a trade mark is $610 for each additional class.  Should you require a ‘Headstart’ early assessment of the likelihood of availability of your trade mark, the fee per class is an additional $80. i.e. a Headstart application in a single class is therefore $975 ($895 as noted above + $80 government Headstart fee).
