Mexico & India Have Joined the Madrid Protocol Countries

Since our last update Mexico and India have joined the list of Madrid Protocol countries available. This means that both of these countries can be included when you file an international application, based on your national Australian trademark. This in turns means much lower costs for protection of your brand in either Mexico or India.

Prior to joining the Madrid Protocol if you wanted to protect a trademark in either of these countries you would have needed to engage the services of an agent in Mexico and India. We would act in that case as the ‘middle man’. Now, we do not need to engage such services of overseas agents for these countries unless your application encounters a problem or opposition. This in turn results in substantial savings to the applicant.

Mexico – Save approx AU$600

Previously a fee of around AU$1150 – $1250 could have been expected to secure registration of a trademark in a single class of products/services (to include government fees, local and international agent fees and taxes etc).

Now, the fee is only AU$550.00* for a single class to secure registration under the Madrid Protocol – inclusive still of government fees, agent fees and taxes.

India – Save approx AU$1000

Previously a fee of around AU$1350 – $1450 could have been expected to secure registration of a trademark in a single class of products/services (to include government fees, local and international agent fees and taxes etc).

Now, the fee is only AU$350.00* for a single class to secure registration under the Madrid Protocol – inclusive still of government fees, agent fees and taxes.

 

* In both cases, the individual country fees are in addition to filing and handling fees payable when utilising the Madrid system. Please include your Australian trademark number, as a Madrid application needs to be based on a national application or registration in one of the member countries.
